1. Acceptance of Terms
By creating an account or using the Paraserve Paralegal & Process platform ("Paraserve," "the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.
2. Description of Service
Paraserve provides legal support services including process serving, skip tracing, document preparation, legal research, court filing, paralegal support, landlord-tenant services, home and office visits, and private investigation. The Service is a technology platform connecting clients with licensed legal support professionals.
3. Not Legal Advice
Paraserve is not a law firm and does not provide legal advice or representation. Document preparation, legal research, and paralegal support services are provided by certified professionals but do not constitute legal advice or create an attorney-client relationship. For legal advice, consult a licensed attorney.
4. Accounts & Responsibilities
You must be at least 18 years old to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate information when submitting service requests.
5. Subscriptions & Billing
Subscription plans are billed on a recurring basis (weekly, monthly, or yearly) until cancelled. You may cancel at any time from your account settings. Per-case services are billed at the rates shown in the app. Prices are subject to change with notice. Refunds, if any, are determined at our discretion in accordance with applicable law.
6. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Submit false, misleading, or fraudulent information
- Interfere with or disrupt the Service or servers
- Attempt to access unauthorized data or systems
- Use the Service to harass, threaten, or harm any person
7. User Content
You retain ownership of documents and information you upload. By submitting content, you grant Paraserve a license to use it solely to provide the requested services. You are responsible for ensuring you have the right to share any documents you upload.
8. Intellectual Property
The Service, including its design, features, and content, is owned by Paraserve and protected by intellectual property laws. Auto-generated documents are provided for your use but the underlying templates remain our property.
9. Service Limitations
We do not guarantee specific outcomes in legal matters. Service availability, timelines, and results may vary based on jurisdiction, third-party cooperation, and case complexity. We are not responsible for delays caused by courts, recipients, or other third parties.
10. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
11. Limitation of Liability
To the maximum extent permitted by law, Paraserve shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of the Service.
12. Indemnification
You agree to indemnify and hold Paraserve harmless from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
13. Termination
We may suspend or terminate your account if you violate these Terms or for any other reason at our discretion. You may delete your account at any time.
14. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms in the app and updating the "Last updated" date.
15. Governing Law
These Terms are governed by the laws of the State of Michigan, without regard to conflict-of-law principles. Any disputes shall be resolved in the courts located in Wayne County, Michigan.
